By completing a purchase of any digital product ("Plugin", "Mod", or "Product") sold through GeneX Plugins ("we", "us", "GeneX"), you ("Buyer", "Licensee") agree to be legally bound by these Terms of Sale and End-User License Agreement ("Agreement").

These Terms are made available to you before purchase completion, as required by Decreto nº 7.962/2013, Art. 4. A summary is displayed at checkout. Completing the purchase constitutes your acceptance.

Nothing in this Agreement overrides or waives rights granted to you by the Código de Defesa do Consumidor (Lei nº 8.078/1990) or any other mandatory Brazilian consumer protection law. In case of conflict, the CDC prevails.

Upon successful payment, GeneX grants you a personal, non-exclusive, non-transferable, revocable license to install and use the purchased Product solely for your own Minecraft server(s) or client(s), subject to the restrictions in Section 5.

This license covers the Product version(s) available at the time of purchase. Future updates are not guaranteed unless explicitly stated in the product listing.

• Install the Product on your own Minecraft server(s) or client(s).
• Use the Product for both non-commercial and commercial server networks.
• Configure the Product using its built-in settings, config files, or API.
• Create derivative configurations (e.g., custom config files) for use on your own servers.
• Request a refund within the window defined in Section 8.

The following are strictly prohibited and constitute a material breach of this Agreement:

• Redistribution. You may not share, publish, upload, or otherwise distribute the Product's files - compiled or source - on any platform, forum, repository, or file-sharing service.
• Resale or sublicensing. You may not sell, rent, lease, or sublicense the Product or any portion of it to any third party.
• Decompilation and reverse engineering. You may not decompile, disassemble, or reverse-engineer any compiled Product, except where such restriction is expressly prohibited by applicable law.
• Modification for redistribution. You may not modify the Product and distribute the modified version to others, whether free of charge or for payment.
• Claiming authorship. You may not remove, obscure, or alter any copyright notices, credits, or attribution within the Product.
• Account sharing. Your GeneX account and purchase entitlements are personal and may not be shared with or transferred to another individual or entity.

All Products sold through GeneX Plugins are the exclusive intellectual property of GeneX (Fabricio / GeneX Plugins), protected under Brazilian copyright law (Lei nº 9.610/1998) and applicable international treaties. All rights not expressly granted in this Agreement are reserved.

Purchase of a Product does not transfer ownership, copyright, or any other intellectual property right to the Buyer.

Custom-order deliverables are owned by GeneX until full payment is received. Upon full payment, a license equivalent to Section 3 is granted unless a separate written agreement specifies otherwise (e.g., full source + IP transfer for an agreed price).

GeneX Plugins is not affiliated with, endorsed by, or sponsored by Mojang Studios or Microsoft Corporation. "Minecraft" is a registered trademark of Mojang Studios.

All Products are independently developed software designed to run alongside Minecraft and are distributed in compliance with Mojang's Commercial Usage Guidelines. GeneX Plugins does not distribute any part of the Minecraft game itself.

GeneX is not liable for disruption, incompatibility, or damage arising from Minecraft game updates, server software changes, or third-party plugin conflicts.

Right of withdrawal (Brazilian consumers - CDC Art. 49): You have the unconditional right to withdraw from any purchase made remotely within 7 (seven) calendar days from the date of purchase, with full refund, regardless of whether the Product has been downloaded or accessed. To exercise this right, contact us at support@gxplugins.com within that period. Refunds will be processed using the same payment method used for the purchase, within 10 business days.

Defective product (CDC Art. 18 & 20): If a Product presents a defect or fails to perform as described in the listing, you have 30 (thirty) days from purchase to report the issue. We will first attempt to correct the defect. If the defect cannot be corrected within 30 days, you are entitled to choose between: (i) replacement with an equivalent product; (ii) a proportional price reduction; or (iii) a full refund.

Other refund requests: Outside the periods above, refunds are not available as a general policy but may be considered at our discretion on a case-by-case basis.

GeneX warrants that each Product will substantially perform the functions described in its listing at the time of purchase. If you experience a defect, report it within 30 days as described in Section 8 and we will work to resolve it.

We do not warrant that the Product will be compatible with every third-party server configuration, plugin, or future Minecraft version. Incompatibility caused by Minecraft updates or third-party software is not considered a product defect under this warranty.

This warranty does not limit any rights you have under the CDC or other applicable Brazilian law.

To the extent permitted by Brazilian law - and without prejudice to any mandatory consumer rights under the CDC - GeneX's liability for any claim arising under this Agreement shall not exceed the amount actually paid by the Buyer for the Product in question.

GeneX is not liable for indirect or consequential damages such as lost profits, server downtime, or data loss, except where such exclusion is prohibited by mandatory Brazilian consumer law.

This license is effective until terminated. GeneX may terminate your license if you materially breach this Agreement and fail to remedy the breach within 15 days of written notice. Upon termination, you must cease all use of the Product and delete all copies in your possession.

Termination for breach does not entitle you to a refund, unless the breach is caused by a defect in the Product as described in Section 8.

This Agreement is governed by the laws of the Federative Republic of Brazil. Brazilian consumers retain all rights granted by the Código de Defesa do Consumidor, which shall prevail over any conflicting provision of this Agreement.

Disputes may be submitted to the Brazilian consumer protection system (PROCON), the National Consumer Secretariat (SENACON), or the competent Brazilian courts. Consumers also have access to the online dispute resolution platform at consumidor.gov.br.

GeneX reserves the right to modify these Terms of Sale at any time. Changes will be posted on this page with an updated effective date. For purchases already completed, the terms in effect at the time of purchase apply. New purchases made after a change is posted are governed by the updated terms.
